I’m in jail and it has been 20 months!

To be correct, we still do not have our audience of intermediate stage … 

And there is no way that I can discuss the charges before the judge can see the truth!

After my first statement in January 2015 until the present day our family still has no audience, prosecution must discuss their accusation. All this time there is always a formal pretext and before we reach the date they change what had already been scheduled.

They change the judge. Public Ministry, began after the famous corruption processes and our audience was often suspended because some other processes have priority … But what about ours? Don’t my family and I deserve some priority, I ask?

I understand all that, but it’s hard to be in jail 18 months without the chance to defend myself before the judge is able to call attention of Ministry for seeing me in prison for 18 months without direct evidence on me or my family.

Public Ministry prepared their memorial indictment that should be discussed before the judge, when I read the indictment it says that my wife, my daughter and I took personal identification documents of our own without any proof, they just say we did it and that is it, they must believed it all.

We as immigrants have no knowledge about what a government organization as it is RENAP administratively does, because for that one reason MIGRANTS seek help to know the legal procedures to get there without causing problems, then we hired the law firm “Cutino International” they took charge of all government official Windows for usat the RENAP because when we came to Guatemala we did not speak or wrote Spanish only our native language, English and Russian and it was where we received our legal documents from RENAP.

The prosecution has no proof that we have faked or altered documents, do you want to know why? Because we did not, it is simple you can not prove something that was not done, and those lies would not be able to be taken  to the judge.

You know, I think the same public prosecutor appears not to believe in their own absurd accusation.

I explain why: When they abusively put our little son Vladimir into the Orphanage, we proposed a trial without  being frozen called abbreviated procedure.

In other words we explained that we accept a misdemeanor use of forged documents .. and instead we were promised free us out immediately and recover our son at the orphanage … The proposal was tricky, because then we could be extradited to Russia I think.

It is nothing original, this strategy the Public Ministry is using of taking a person to jail and then propose freedom in exchange for accepting some misdemeanor crime. Many developing countries use this evil practice. Precisely for this reason. UN in its Rule Tokyo, solution 45/110 of 14 December 1950, recommended the nations NOT USE PREVENTIVE DETENTION, that this measure serves to torture the processed and hampers justice.

In our case, public prosecutor used preventive detention as a psychological torture. We know that behind all those abuses it is the Putin government with all their corrupt practices.

At that time we still did not know that there is international law. PALERMO CONVENTION directly prohibiting involvement in criminal proceedings migrants by using forged documents. Guatemala ratified this law in 2003 and must comply, because international conventions ratified by Guatemala in matters of human rights should be seen as priorities. Our first lawyers never mentioned this law through ignorance or bad faith. current lawyers know this, but justice FROZE.

Why PALERMO CONVENTION “prohibits meter migrants to criminal proceedings by use of forged documents? This law was created as a solution to the problem of migrants, who for economic or political reasons seek salvation in other countries. Nobody flees good life. Migrants sometimes have only one purpose: save their lives .. As we do, for example when Jews were trying to save their lives from persecution in fascist Germany, many of them used forged documents to emigrate. For that reason they were captured and handed over to the hands of fascists where they lost their lives.

Today many immigrants from Latin America, Asia, Africa are seeking a new life in countries in Europe and North America. Imagine that! If most of them had gotten into prison for using false papers, most of them have done that.

We got our papers in government offices with the help of the law firm “Cutino International” with new documents we could work in the country as entrepreneurs, employing initially to more than 30 Guatemalan families and we are in jail!

Our legal position is quite simple by law, we must never be in jail for even one day. because we are immigrants who were victims of a transnational network of smuggling of migrants and punish us as we were guilty. It is time that the MP open their eyes and see that they were used as a tool to destroy us by the Russian government, through misinformation that the MP could provide them corrupt authorities, in order to give them fresh flesh to build a case that will fall under its own weight …

But we are in prison because there are powerful influence of the Russian government, which penetrates the criminal investigation giving bad information to the MP from the outset.

Being in jail 18 months without a hearing intermediate stage is illegal.

So they made appeals after 8 months of waiting which ran out of place, but without any explanation. Their injunctions that are still unresolved, we made two personal exhibitions and judges do not take any resolution and then they send the job to the constitutional court, where now the record sleeps off away from justice.

I write this not to complain, I just want to acknowledge that injustice is presenting in Guatemala and may affect any citizen, not just migrants like us and to tell all of you that justice remains frozen …
